Bayer-Monsanto won’t stop. Neither can we.
German-owned Bayer-Monsanto, China-owned Syngenta, and the rest of the pesticide industry will stop at nothing to secure immunity from future pesticide-harm lawsuits. Bayer, Big Chemical, and Big Ag are lobbying like never before, capturing the White House and federal regulatory agencies to do their bidding.
At the state level, Bayer has been able to get three pesticide-harm immunity bills over the finish line. In North Dakota, HB1318 passed along party lines and was signed into law by Governor Kelly Armstrong in April 2025. SB144 passed both houses in Georgia, along party lines, and was signed into law by Governor Brian Kemp in May 2025.
On March 19, 2026, the Kentucky state legislature passed SB199. Unlike the governors of ND and GA, KY Governor Andy Beshear vetoed the bill on March 31. But Bayer’s puppets in the KY State Senate and House moved quickly, marshaling enough votes to override Gov. Beshear’s veto the very same day. The KY Senate veto override passed 24-12, with six Republicans crossing the aisle to join all Democrats attempting to stop the override. The KY House veto override passed 56-32, with thirteen Republicans voting against, along with all Democrats. It wasn’t enough to stop the override and SB199 is now law in Kentucky.
The good news is that we, the people, have staved off efforts in the other states where Bayer and pesticide lobbyists have been most active. Activists on the ground, on the phones and online are making a difference.
But this is far from over.
At the end of April, the Supreme Court will hear Monsanto Company v. John L. Durnell, Monsanto’s appeal of a Roundup-cancer trial it lost in 2023. If the Court should rule in favor of John Durnell, it will be a major win for our constitutional right to sue when harmed—but the stakes are high. You can be sure Bayer-Monsanto will quickly ramp up a full-scale push for pesticide immunity bills in state legislatures across the country, aiming to secure through law passed by bought-and-paid-for politicians what they couldn’t win in court. While the public celebrates, lobbyists will be working overtime behind the scenes. And don’t expect Roundup to disappear—Bayer’s threat to pull it off the market will fade as profits prevail. This is why it is imperative that we keep up the pressure on our state legislators now.

FLORIDA HB443/SB518: Pesticide immunity bills were stopped in 2025 and so far in 2026. House Bill 443 died in the Civil Justice & Claims Subcommittee on March 13, 2026. Senate Bill 518 died in the Judiciary Committee on March 13, 2026. Floridians should continue to contact their legislators, demanding they stop bringing forth pesticide immunity bills. GEORGIA SB144: PASSED. Signed into law by Governor Brian Kemp on May 9, 2025.
IDAHO HB303: House Bill 303 failed to move forward during the 2025 legislative session. But legislation may be reintroduced at any time. Idahoans should continue contacting their legislators to prevent any bills from moving forward, remain vigilant and we’ll keep you abreast of any updates.
IOWA SF394: Senate Bill 394 died in committee in 2025 and 2026. Iowans should continue contacting their legislators to prevent any bills from moving forward. Remain vigilant and we’ll keep you abreast of any updates.
KANSAS HB2476/SB390: House Bill 2476 was introduced on January 20, 2026. Senate Bill 390 was introduced on January 27, 2026, and was originally written to prohibit certain food additives from being served in school meals. SB390 would have banned ingredients such as brominated vegetable oil, potassium bromate, propylparaben, titanium dioxide, and artificial food dyes. It was a good bill. Unfortunately, Republicans amended SB390 to add a pesticide immunity poison pill. SB390 is no longer a good bill. Kansans should continue contacting their legislators to prevent these bills from moving forward.
KENTUCKY SB199: PASSED. Senate Bill 199 passed both houses on March 19, 2026. Governor Andy Beshear vetoed the bill on March 31. The Senate and House successfully voted to override the governor’s veto.
LOUISIANA SB108: Senate Bill 108 was pre-filed in the Senate on February 22, 2026, but was withdrawn prior to introduction. Louisianians should continue to contact their legislators to prevent another bill from being introduced. Remain vigilant and we’ll keep you abreast of any updates.
MISSISSIPPI HB1221/SB2472: House Bill 1221 died In committee in 2025. Senate Bill 2472 was placed on the calendar for the 2025 legislative session, but did not move forward. Mississippians should continue to contact their legislators to prevent another bill from being introduced. Remain vigilant and we’ll keep you abreast of any updates.
MISSOURI HB2712/SB1005: In 2025, HB544 died in the chamber. New bills were introduced in 2026. House Bill 2712 has had readings. On March 11, 2026, Senate Bill 1005 was voted out of the Agriculture, Food Production and Outdoor Resources Committee. It has not yet been brought to the Senate floor for a vote. Missourians should take action now and ask all of their family and friends to do the same.
MONTANA HB522: House Bill 522 died in process in May 2025. Montanans should continue contacting their legislators to prevent any pesticide immunity bills from being introduced. Remain vigilant and we’ll keep you abreast of any updates.
NORTH CAROLINA SB639: Senate Bill 639 did not move forward in 2025, but may be revived in 2026. North Carolinians should continue contacting their legislators to prevent SB639 from moving forward. Remain vigilant and we’ll keep you abreast of any updates.

TENNESSEE HB809/SB527: The bills died in committee in 2025. House Bill 809 was re-introduced in January 2026. The House Judiciary Committee was scheduled to hear HB809 on January 21, 2026, but due to public outcry it was “taken off notice.” Tennesseans should continue to contact their legislators to prevent new pesticide immunity bills from being introduced. WYOMING HB285/SF74: House Bill 285 died In committee in 2025. Senate Bill 74 was introduced in February 2026, but was not voted out of committee. Though bills are not expected to be re-introduced, Wyomingites should continue contacting their legislators to prevent new pesticide immunity bills from being introduced. Remain vigilant and we’ll keep you abreast of any updates.
Here’s a quick overview of what is happening on the federal level:
- Bayer petitioned the EPA to modify pesticide labeling regulations that would effectively give it, and the entire pesticide industry, nation-wide immunity.
- Monsanto filed an appeal with the Supreme Court of the United States (SCOTUS) of a Roundup-cancer trial it lost in 2023. Trump’s Solicitor General filed briefs in December 2025 and again in March 2026 urging the Court to side with Monsanto. SCOTUS scheduled the appeal hearing for late April 2026. If SCOTUS rules in Monsanto’s favor, it could bring all pesticide lawsuits to a screeching halt.
- Meanwhile, Bayer and Big Ag lobbying groups like CropLife America and the American Farm Bureau Federation are using their political influence in Washington D.C. to ramp up campaigns for a legal shield on the federal level. House Republicans added Section 453, a provision giving the pesticide industry immunity, to the Appropriations Bill Fiscal Year 2026 (federal spending bill). It was later removed after massive public outcry.
- Republicans’ latest initiative: forcing us to play the game of whack-a-mole by adding three provisions into the 2026 Federal Farm Bill that would provide the pesticide industry with permission to poison without accountability.
The public doesn’t have direct influence over the Supreme Court—but we do have power where it matters right now: in our statehouses and in Congress. While we can’t control how the justices rule, we can stop lawmakers from handing pesticide companies immunity through legislation. And no matter what the high court decides, the fight to protect our constitutional rights doesn’t end—because even Supreme Court rulings can be challenged and ultimately overturned.
And although Georgians, North Dakotans, and Kentuckians have already had their state rights stripped away, all is not lost.
Federal Senate Bill S2324, the Pesticide Injury Accountability Act, has been introduced. It would amend FIFRA (the Federal Insecticide, Fungicide and Rodenticide Act of 1972) to create a federal right of action for anyone who is harmed by a toxic pesticide. If passed, it would restore the rights of citizens of GA, ND, and KY and allow them to sue in a federal court if they are harmed by pesticides. Tell your U.S. Senators to co-sponsor and pass S2324. And these pesticides enter our food sources from all areas from crops that are non-GMO which are downstream from farms that use harmful pesticides and results is that it can end up on his farms who sustained from using any harmful pesticides or chemicals!

If the federal government isn’t going to help, each state must pass laws to protect the farms and the people. Almost every state has agriculture on some level. That is why each state must pas laws to keep these destructive pesticides out. We cannot have this overkill, where beneficial insects killed. We may have to have lower yields to protected the beneficial insects.
